Did you hear about the latest Facebook Ad Policy on promoting CBD on Facebook? If you have been looking for ways to market your CBD business on social media, you may already know the complications; Facebook does not allow it. However, things are about to change.

Facebook (Meta) announced that it wants people to learn about new things. It renamed its advertising policy Hemp & Related Products to CBD & Related Products, legally permitting the marketing of non-ingestible CBD in the U.S. Of course, some restrictions still apply.

What’s in the New Policy Update?

According to the new policy, marketers do not need written permission to run ads that:

  1. Market or offer the sale of hemp products containing CBD or THC with the 0.3% THC threshold in the United States, Canada, and Mexico as long as they comply with the applicable local laws and industry codes and guidelines.
  2. Educate, advocate, or make a public service announcement (PSA) on CBD and related products as long as the ads do not offer restricted products for sale. However, ads promoting cannabis or THC products contain psychoactive components.
  3. Also, marketers can only run ads promoting CBD for sale that do not contain over 0.3% THC as long as they:
  • Adhere to all local laws, industry codes, and guidelines,
  • Are certified with LeigtScript and have written permission from Meta,
  • Do not target people under 18,
  • And are only allowed in the U.S.

These updates do not apply to products subject to Prescription Drugs, so marketers promoting such products should continue to comply with the Prescription Drugs policy. Now, let’s answer the real question:

As you read before, Meta now allows the selling of CBD educational products. Educate, advocate, or make a public service announcement (PSA) on CBD and related products as long as the ads do not offer restricted products for sale. Ads promoting cannabis or THC products containing psychoactive components. However, with many Facebook automation designed to scan and ban CBD ads, how applicable is this new policy?

The automation does not account for intent, even if you only sell educational content about CBD. So, even if all you intend to do is educate people, the automation may misinterpret the ads and ban you. In that case, you must appeal and hope to get approval from Meta. Sometimes, it may ask you to confirm your identity or verify your Facebook Business Manager. Why go through all the hassle? Take it easy with running your CBD ads on this platform.

If you are using email marketing services, companies like Click Funnels, Active Campaign, or Aweber won’t allow you to market CBD in an email newsletter.

Picture this: you got LegitScript certified, written Meta permission for running CBD ads, complied with the applicable laws, initiated your CBD ads, and sent an email from the automated welcome sequence talking about CBD, you may be violating CAN-SPAM acts and get terminated from the email marketing service.

So, even with the new policy, you must consider many things to avoid a potential ban. If you ran an expensive ad campaign already and got banned, you should consult with a reputable CBD social media marketing agency, for they can help you.
